Terms and Conditions
General provisions and basic definitions
These Terms and Conditions set out the rules for using the digital services and digital products offered by Alicja Koperska, operating a sole proprietorship under the name Alicja Koperska, Tax ID (NIP): 6772461589, ul. Kujawska 13, lok. 2, 30-043 Krakow, Poland (hereinafter: the “Service Provider”), via the website available at www.akoperska.com, e-mail: sayhi@akoperska.com.
Whenever these Terms and Conditions refer to a consumer, this means a natural person who is a consumer within the meaning given by the provisions of the Polish Civil Code, or a natural person conducting business activity for whom the contract is not of a professional nature, and to whom the law provides for the application of consumer protection provisions.
Service Recipient – a natural person who has reached the age of 18 and has full legal capacity, and, in cases provided for by generally applicable law, also a natural person with limited legal capacity, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, who has entered into or intends to enter into a contract with the Service Provider.
Distance contract – means a contract concluded between the Service Provider and the Service Recipient as part of an organized system for concluding distance contracts, without the simultaneous physical presence of both parties, using one or more means of distance communication up to and including the moment the contract is concluded.
Digital Service/Digital Content – a service enabling the creation, processing, and storage of data, or access to data in digital form, or a service enabling the joint use of data in digital form that has been uploaded or created by the Service Recipient or other users of the service, or other forms of interaction using such data.
Product – the Service Recipient’s individual access to Digital Content or a Digital Service that is the subject of the Agreement, granted for a specified period in accordance with the Agreement. The Product description and gross prices are available on the website alongside the Content or Digital Service presented. Document templates are intended for self-editing, allowing the User to personalize the document according to their needs.
Scope and conditions of service provision
- The Service Provider provides digital services and sells electronic products (online training, templates, and online consultations) of its own authorship, together with training and exercise materials, graphic files, and audio files, which fulfills the definition of providing a service to the Service Recipient electronically, in accordance with these Terms and Conditions.
- Proper use of the digital services and products offered requires access to a device with an internet connection, an up-to-date operating system, an up-to-date web browser, an active e-mail account in any domain, and the use of a standard PDF file reader.
- In case of doubts regarding technical requirements, the Service Recipient is required to contact the Service Provider by e-mail at sayhi@akoperska.com before making a purchase.
- The sale of digital services and products is carried out via Easy Cart, belonging to Easytools sp. z o.o., with its registered office in Warsaw, at al. Rzeczypospolitej 10/46, 02-972, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register under number 0001002028, Tax ID (NIP): 9512554309.
- Using the services described in these Terms and Conditions requires reading and accepting all provisions of these Terms and Conditions.
- The purchase of digital services and products is made by selecting the “Buy now” option, which redirects the Service Recipient to the cart view operated by Easy Cart.
- Upon placing an order, the Service Recipient is required to make payment for the ordered products. Once payment has been credited, the Service Recipient receives an electronic invoice confirming the purchase, sent to the e-mail address they provided.
- Prices of Digital Content and Digital Services are presented on the website www.akoperska.com and during the ordering process. All prices shown on the website are gross prices, inclusive of taxes.
Order fulfillment – courses: consultations and online training
- After purchasing a course, the Service Provider contacts the Service Recipient by e-mail, presenting the nearest available training or consultation dates.
- Courses are conducted on a previously agreed date. Changing the agreed date is only possible with the Service Provider’s approval.
- Upon completion of the training, the Service Recipient receives a certificate of participation. Consultations are not certified.
Order fulfillment – templates
- Once payment for templates has been credited, the User receives, by e-mail, a PDF file with a link to the editable templates, which they may download and adapt to their own needs.
- All templates are protected by copyright and may be used exclusively for the Service Recipient’s own purposes. Reselling, copying, or sharing the templates with third parties is prohibited.
- A product that is a document template does not include individual consultations, including those related to implementing the document.
Withdrawal from the contract – Mandatory notice
- If, during the purchase process, the Consumer consented to the performance of the Agreement and the delivery of content or a Digital Service before the expiry of the withdrawal period, they lose the right to withdraw from the Agreement concluded with the Service Provider.
- If the Agreement concerns the provision of Electronic Services, and the Service Provider has fully performed the Electronic Service with the express consent of the Consumer, who was informed before the service began that they would lose the right of withdrawal once the service was performed, then the right of withdrawal will not apply.
- In all other cases, the Consumer has the right to withdraw from the Agreement without giving any reason within 14 days of the date the Agreement was concluded.
- Beginning to use the Digital Service before the expiry of 14 days from the date of purchase results in the loss of the right to withdraw from the Agreement.
- Withdrawal from the Agreement is effected by informing the Service Provider of the decision by means of a statement. Such a statement may be sent by e-mail to the address provided in these Terms and Conditions.
- To meet the withdrawal deadline, it is sufficient for the Consumer to send information regarding the exercise of their right of withdrawal before the expiry of the specified withdrawal period.
- In the event of withdrawal from the Agreement, the Service Provider will refund the Consumer all payments received from them, using the same payment method chosen by the Consumer in the original transaction.
Intellectual property
- Products made available to the Service Recipient are protected by copyright.
- Products may also contain protected trademarks.
- Products are made available to the Service Recipient exclusively for personal use. Any other forms of use of the Products violate the rights of the Service Provider or other authorized parties and may result in civil or criminal liability. In particular, further copying, reproducing, recording, or distributing the Products without the consent of the Service Provider or other authorized parties is prohibited.
- The Service Provider is not responsible for how the knowledge obtained from the Products is used, or for any direct or indirect damages resulting from the use of the Products.
Newsletter
- The Newsletter subscription service is provided free of charge by the Service Provider to Service Recipients who voluntarily consent to it.
- To subscribe to the Newsletter, the Service Recipient performs the following actions: (a) orders the Newsletter service via the form available at https://akoperska.com and by providing their e-mail address; (b) accepts the content of these Terms and Conditions and consents to receiving commercial information by electronic means of communication related to the Newsletter service; (c) activates the “Subscribe” button;
- Upon “subscribing,” an agreement for the provision of the Newsletter service for an indefinite period is concluded between the Service Provider and the Service Recipient.
- The Service Recipient may terminate the Newsletter service agreement at any time by deactivating the subscription. Cancellation of the Newsletter is done by sending such a statement of intent to the e-mail address sayhi@akoperska.com.
- Consent to receive commercial information by electronic means of communication sent by the Service Provider is voluntary, and the Service Recipient may withdraw it at any time.
Complaints regarding Services/Digital Content
- The Service Provider is liable to the Consumer for the lack of conformity of Digital Content or a Digital Service with the Agreement for the supply of Digital Content or Digital Services, existing at the time of delivery and disclosed within 2 years from the moment of delivery.
- Digital Content or a Digital Service is conforming with the Agreement for the supply of Digital Content or Digital Services if, in particular, its description, type, quantity, and completeness conform to the Agreement.
- The Service Provider is not liable for the lack of conformity of Digital Content or a Digital Service with the Agreement for the supply of Digital Content or Digital Services if the Consumer was expressly informed, no later than at the time of concluding the Agreement, that a specific feature of the Digital Content or Digital Service deviates from the conformity requirements of the Agreement, and expressly and separately accepted the absence of that specific feature.
- The Consumer may not withdraw from the Agreement for the supply of Digital Content or Digital Services if the Digital Content or Digital Service is supplied in exchange for payment of a price, and the lack of conformity of the Digital Content or Digital Service with the Agreement is immaterial.
- A statement of non-conformity of the product with the Agreement for the supply of Digital Content or Digital Services (Complaint) may be submitted by the Consumer to the e-mail address sayhi@akoperska.com.
- The Service Provider undertakes to review the complaint within 14 days and notify the Service Recipient of how the complaint was resolved.
- The Service Provider excludes its liability under statutory warranty towards Service Recipients who are entrepreneurs, in accordance with Art. 558 Section 1 of the Polish Civil Code.
Final provisions
- These Terms and Conditions, together with all operating rules published by the Service Provider, constitute the entirety of the agreement concluded with the Service Recipient.
- If any provision, or part of a provision, of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, that provision or part of a provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
- Changes to the Terms and Conditions take effect from the day following the day of their publication.
- Polish law is the governing law for obligations performed under these Terms and Conditions.
- The court having jurisdiction to resolve any disputes with the Service Provider is the court having jurisdiction over the Service Provider’s registered office.
- These Terms and Conditions take effect as of the date of publication on the website www.akoperska.com.
Terms and conditions governing the use of discount codes and promotions on www.akoperska.com
General provisions and basic definitions
- These Terms and Conditions set out the rules for using promotions and discount codes that reduce the price of digital services and digital products offered by Alicja Koperska, operating a sole proprietorship under the name Alicja Koperska, Tax ID (NIP): 6772461589, ul. Kujawska 13, lok. 2, 30-043 Krakow, Poland (hereinafter: the “Service Provider”), via the website available at www.akoperska.com, e-mail: sayhi@akoperska.com.
- Discount code – a string of alphanumeric characters enabling a reduction in the price of selected products or services in accordance with the conditions specified by the Service Provider.
- Promotion – a special offer limited by time and/or quantity, the details of which are specified in promotional announcements published by the Service Provider.
- Discount codes and promotions may only be used in accordance with the provisions of these Terms and Conditions and the terms and conditions for using the website www.akoperska.com, available at https://akoperska.com/regulamin/.
- Discount codes and promotions may not be exchanged for cash or other benefits.
- The Service Provider reserves the right to invalidate discount codes or promotions if abuse, actions contrary to the principles of fairness, or actions detrimental to the Service Provider are detected.
Conditions for using discount codes
- A discount code may be used once by a single Service Recipient, unless otherwise indicated in the offer details.
- Two discount codes may not be used in a single purchase.
- A discount code is valid during the validity period specified by the Service Provider. After this period, the code becomes invalid.
- The discount code must be entered in the appropriate field during the ordering process. Incorrect entry of the code will result in it not being accepted by the system.
- Discount codes cannot be combined with other discount codes, unless the details of a specific promotion state otherwise.
Conditions for using promotions
- Promotions organized by the Service Provider are either ongoing or limited in time, in accordance with their specific terms.
- Promotions may not be transferred to third parties without the Service Provider’s consent.
- Promotions cannot be combined with each other, unless the terms of a specific promotion state otherwise.
- In the event of a violation of the promotion’s rules, the Service Provider has the right to invalidate the Service Recipient’s participation in the promotion.
Complaints
Any complaints regarding discount codes or promotions should be submitted in accordance with the rules set out in the terms and conditions for using the website www.akoperska.com, available at https://akoperska.com/regulamin/.
Final provisions
- The Service Provider reserves the right to change the rules for using discount codes and promotions at any time. These changes take effect from the moment they are published on the Service Provider’s website.
- In matters not regulated by these Terms and Conditions, the relevant provisions of the terms and conditions for using the website www.akoperska.com, available at https://akoperska.com/regulamin/, shall apply.
- Any disputes arising from these Terms and Conditions shall be resolved by the court having jurisdiction over the Service Provider’s registered office.
- Using discount codes and promotions constitutes acceptance of these Terms and Conditions.
- These Terms and Conditions take effect as of the date of publication on the website www.akoperska.com, available at https://akoperska.com/regulamin/.
